One Island, Two Rulebooks: Gambling Law In Ireland vs Northern Ireland

The Republic of Ireland and Northern Ireland are both on the same island, but their gambling laws are governed by two entirely separate rulebooks. When it comes to self-exclusion, advertising, and regulatory oversight, a system that applies in Dundalk does not necessarily port across the border to Newry. Here is what gamers, players and regulators cannot safely assume.

The Republic's New Rulebook

The Republic of Ireland has a new central regulator overseeing brick-and-mortar and online gambling. The Gambling Regulation Act 2024 founded the Gambling Regulatory Authority of Ireland (GRAI) to license and regulate betting, gaming, lotteries, and related services. That includes a National Gambling Exclusion Register to exempt people who wish to self-exclude.

"An individual registered will not be able to register to gamble, have a gambling payment accepted, or be communicated with in a way that promotes gambling," says Citizens Information, a public service that explains government departments and laws. The GRAI oversees gambling licenses and handles complaints.

But the updated rules also include tight social protections. "When the Gambling Regulation Act 2024 is fully commenced, gambling advertising on television and radio will be banned between 5:30 am and 9:00 pm," Citizens Information says. Advertising is banned by default on social media and on-demand platforms. The GRAI's broad control is new; it will be fully operational in due course, according to the Irish Government.

Northern Ireland's Older Regime

As of 2024, Northern Ireland's gambling rules remain under the Betting, Gaming, Lotteries and Amusements (Northern Ireland) Order 1985. The 1985 Order was amended by the 2022 Betting, gaming, Lotteries and Amusements (Amendment) Act, but left Northern Ireland with a very different regime to the Republic. Self-exclusion in Northern Ireland operates as an industry-led scheme, run through licensed venues and operators.

"All licensed arcades, betting shops, bingo halls, casinos and online gambling operators offer a gambling self-exclusion service," says the Northern Ireland Department for Communities, the body overseeing gambling regulation. "A self-exclusion applies to the licensee concerned, not across all gambling operators." That leaves potentially greater risk for players who cross the border.

This jurisdiction also involves several regulators. "Regulation of gambling advertising in Northern Ireland is primarily under the Gambling Commission, the Advertising Standards Authority and Ofcom," says a paper by the Northern Ireland's Assembly Research and Information Service, describing the bodies that could weigh in on advertising or promotions.

What Follows the Player, and What Does Not

The question of self-exclusion across jurisdictions remains open. A player can self-exclude, or require a time or loss limit, with a licensee in either jurisdiction. But to this date, neither jurisdiction confirms an individual self-exclusion travelling across the border. The same Northern Ireland Assembly paper states that a licensee will not be allowed to interact with a registered player, but does not clarify how or whether the register applies in cross-border play.

In the Republic, "A person's right of self-exclusion directly with a licensee is not incompatible with the National Government Exclusion Register, and nor does the Register affect it," the Irish Government's explanatory note on the Act says. "So that a person who is registered on the National Register is still able to self-exclude directly where they wish it." That, however, is their direct right against a licensee and not a portability of the exclusion itself.

This practical question probably arises most often in cross-border settings. For example, a player in Dundalk excluded through an online gambling site is unlikely to have the same protection immediately within Newry. "Excluded persons in Dundalk are registered with Údarás Rialála Cearrbhachais na hÉireann," says Citizens Information, using the Irish name of the regulator. "But given the two jurisdictions, I'd be surprised if the exclusion would have the same legal effect in Newry."

Advertising and the Search Trap

Players searching online for gambling advice must be aware of which regime applies to them: not all ideas carry over the border, and not every idea will have the same legal effect on both sides. This becomes visible in advertising.

"Comparing Northern Ireland to the Republic, it's actually by default that gambling advertising is banned on social media and on-demand media in the south, while it appears to be more tightly controlled by the bodies named in Northern Ireland," says an expert on online gambling.

The full status of the two rulebooks' commencement dates has not been confirmed, which could affect their impact or reach. Neither jurisdiction is currently denying or confirming the cross-border effect of an exclusion, registration, or self-exclusion. The rules can often reinvent themselves, but at present Jill on the Ulster bank would not be guaranteed Alan on the Liffey a ported, nor a wider, exclusion.

Complaints, Licences and Consumer Routes

Players are unable to use a single set of rules or routes from Dundalk to Newry. Citizens Information says that licensed gambling providers, staff, and anyone helping to promote or operate a business in the Republic must follow the Gambling Regulation Act 2024, with the GRAI as first port of call. But that oversight is limited to the Republic's gambling operations.

Where the gambling takes place rules where the player is. "Irish residents who gamble in destination businesses under the jurisdiction of another country should remember if either gambling is illegal in that country, or the legislation is different from Irish standards, they may have less protection," Citizens Information says. So if the gambling is happening overseas, the player has reduced protection. "For example, a person who is on the National Gambling Exclusion Register cannot be approached by a licensed gambling business in Ireland but can by an overseas operator who knows nothing about the exclusion."

This is even more complex in a cross-border game, but less developed in the author's jurisdiction. An Irish citizen "gaming on a Northern Ireland operator's platform" will have, regardless of location, another consumer protection path against the provider, Experts say that the Northern Ireland regime focuses more on asset safety and the operator's standing. Dundalk should not assume the exclusion holds in Newry, and Newry may have another protection against the Irish enterprise.

Border Reality

These different frameworks mean cross-border travel can present special challenges. It is possible for players to be registered in both jurisdictions, especially in cross-border counties.

"There's a lot of confusion about this, but at the moment, the two registers are separate. They don't talk to each other and they are not the same organization." If the day comes when both jurisdictions talk to each other, it will still be separated borders. "Even if full cross-border interoperation does happen, that doesn't mean the same legal result," says the source, "it just means they talk to each other a bit more."

The last point is that Dundalk and Newry are not under the same regime, and some assumptions made in one city's jurisdiction will not travel unfettered to the other. "It's important for players to be very cautious in assuming they carry the same protections from the other jurisdiction's regime," says the source. "And they really need to be clear on whether they're registering with a provider in the North or in the South."
