Why the Tax Bill Usually starts after winning

When the gambler wins, the windfall alone is tax-free. The backdrop is that Revenue treats winnings, including wins at casinos, on bets, from lotteries or companies that feature prizes, as profits that are not taxed. But letting the money pile up can create new forms of taxable income further down the line.

Recreational winnings from casino games, poker, betting, lotteries or a scratch ticket are untaxed no matter the sum. Revenue’s published guidelines specify that this applies to any gambling profits, not just to casino or sports betting. Revenue never flags the winnings as a chargeable gain.

The same turf also holds that the 2% betting duty levied by the operator, paid to Revenue, does not flow through to the player. The levy is payable by the bookie, not by the player.

Where Tax Appears in the Wake of the Windfall

While casino, betting and lottery winnings avoid tax, Revenue has been clear on three settings where gambling profits retain tax hooks as they move from the windfalls: when they compound into income, in the form of a gift or as an inheritance.

The gambler who wins a €10,000 jackpot but then spends the money with no net profit still avoids tax, according to the Lottoland summary. A win that does mount to income, or is subject to conversion of income by the Revenue, does attract income-tax, USC and PRSI in the usual rate.

Tax can hit when winnings are deposited in an interest-bearing bank account. The revenue press release says that interest on deposited winnings can trigger Deposit Interest Retention Tax (DIRT). Gambling pays off at the point the revenue takes DIRT.

Another hook is that gambling winnings distributed as a gift, including to friends or relatives, count towards the annual threshold for CAPITAL acquisitions Tax (CAT) and says so per tax rules. Free gifts from a bank account that originated in a casino or betting jackpot come under scrutiny for tax and under scrutiny at CAT and in accordance with Revenue's scenario.

Who Pays What in the Irish Gambling Chain

While the tax-free orientation holds for gambling profits to the gambler, the operator side sees its own management duties and tax flows.

The Revenue compliance says that tax payer supplied gaming services are liable to Value Added Tax (VAT) at the standard rate of VAT tax on sales. Betting and gaming operators pay that VAT, not the individual gambler.

The same compliance adds that the betting duty that operators collect, 2% of the amount staked, cancels the operator’s tax liability to the revenue. This renders the operator’s betting duty as revenue in Irish bookmakers' earnings. That duty, like VAT, does not flow through to the player.

Where Documentation Still Lags

The Revenue view asks gamblers to supply evidence in three main ways, the Irish regulation states. The same rules also apply to lottery, casino and betting winnings. But there has been no explicit requirement to evidence winnings, the authoritative Revenue rules.

Adding to the uncertainty, Revenue’s VAT compliance says that incomers from gambling receipts should always be declared as taxable income. Revenue guidelines state that it will uncap the limits to follow gambling profits as taxable deposits. This treats gambling profits as unidentified deposits, with no clear evidence from the winnings.

Yet, the same compliance notes a loophole. Gambling and lottery proceeds in some jurisdictions may not be taxed, But the Revenue indicates its office can declare winnings for certain cases.
